Terms of Service

1. GENERAL TERMS
-All drawings may or will include a subtle sign that you may not remove.-I may stream the work on picarto! (unless it is noted to be a gift)-Prices are subject to change based on demand.-I have the right to reject any order that I do not feel comfortable drawing for any reason.-I understand I am a nsfw artist but that doesn’t mean I am comfortable with flirting etc.. I am here to work and run a business! I do not appreciate lewd messages directed to me please keep nsfw images or topics sent to me limited to references or related to the piece I'm working on for you!2. PAYMENT-Currency accepted is USD and can be paid through PayPal or Kofi ! Other payment methods can be discussed!-Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval. I am happy to work with you and am more flexible with payment after you have been a previous client!-Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.3. PROCESS AND DELIVERY-I will notify you when I have started on your commission and you, therefore, lose the rights to a refund (see point 7 further below for more info on refunds)-While I'm working on your commission I will make reviews with you to make sure I make it just right for you! (This doesn’t apply for Artist choice Coms )-The amount of reviews depends on the complexity of the work.-During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece.-The time it takes to finish your commission varies from 1 week to 1 1/2 month depending on factors such as health, the complexity of the commissioned piece, other work, I will keep you updated, hard deadlines will be met and you can keep track of my que on my trello!-If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap.-Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product.4. REVISIONS-These terms mostly do not apply to Artist choice coms! For those you may only make small revisions upon completion of the piece-You get 3 rounds of changes on the commissioned piece included in the price.-A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.-If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.-If your reference is unclear to start with, I will let you know but changes will come at an extra charge.-Critique is one thing, picking apart my art is another! Please remember I am just an artist and not a mind reader, I follow the references and ideas sent, before commissioning me please look at my other works and decide if you like my style or not which is no problem art is subjective to each person! However what is not okay is picking on everything I do within the artwork and being indecisive with changes or approving things and changing your mind constantly. This sort of behavior affects my mental health and I usually have other clients waiting on their work. I would really rather not make them wait for their work.5. COPYRIGHT / USAGE POLICYI dumbestbunbus (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:-Promote myself with it everywhere
-Publish books with it (artbooks, etc.)
-Display it everywhere to my liking (website, social media, etc.)
-Post it wherever I want-Presents and coms that need to be held off on posting until a certain date will not be posted until an agreed date! All coms must be available to post within 365 days of the time of the completed com!The buyer is allowed to under a non-commercial license :Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.) Please credit my social media account to help me grow my platform as an artist!Print the artwork for personal use and claim the character(s) as their own, but not the artwork itself.Use the artwork to promote themselves.The buyer is allowed to under a commercial license :Use the artwork for promotion and posting to social media and other sites without the need to credit me (HOWEVER you may NOT claim the artwork as your own personal work)Print the artwork for merchandising and sale (i.e. Make stickers and t-shirts for profit to sell to others)Under my commercial license you may NOT use my work for any AI or NFT related projects.ALL OF MY WORK IS NOT PERMITTED TO BE USED FOR AI OR NFT RELATED PROJECTS IF I DISCOVER YOU HAVE BEEN USING MY WORK IN RELATED PROJECTS, YOU WILL BE BLACKLISTED FROM MY WORK.The following is considered copyright infringement:Reproducing/using the copyrighted artwork commercially - means making money off it in any way. (Without a commercial license )-Claiming the artwork as your own-Removing my signature from the artwork-Altering the artwork without my consent-I reserve the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).6. CUSTOMER SATISFACTIONI will do everything I can to make my customers happy!-If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together within reason-I am willing to change some of my terms for you if you ask! I am always happy to come up with happy solutions!7. REFUND / CANCELLATION POLICY-The buyer is not allowed a refund once I start working on the commission.-If for any reason I am unable to start your commission you will receive a full refund.-If you cancel your order before I started it, you can get a full refund.-If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.-If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.-If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the artwork commissioned by me, dumbestbunbus (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.What do you get?
-Drafts/mockups (Choosing pose ect, this is the roughest version of the work)-Sketch and/or final sketches that you must accept before I continue the work-Line Work with flat colors! (Note the flat colors are not the final color of the piece, they are usually the mid tones of the work, meaning areas will be darker and lighter around the work! I also clean up bits of line work in the rendering phase, the composition of the linework is usually an indication of the final piece )-Terms above DO NOT APPLY to Surprise artist Choice Coms! You will just send ideas and I will choose pose and everything you just wait for the final render!-Final render and if needed any SMALL corrections (EX: I forgot a mole, or a slight change in color in an area)-Full-resolution file (300 DPI) of final drawing and a smaller version for internet upload. Final file formats are usually PNG, I can send JPGs and other versions upon requestTerms of Service:-By purchasing a commission from me (the artist) you agree to be purchasing my services only. If you have a problem with any of the below conditions, they may be changed if discussed with me prior to paying for your commissioned piece.Please read the terms carefully:I, Dumbestbunbus (the artist):-I reserve the right to cancel and refund the order at any time for any reason.
-I retain all copyrights over the commissioned artwork.
-I will NOT claim the intellectual property (IP) of the commissioned artwork.
-I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.-I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books. (If the work is a gift or needs to be held off on posting for any reason please note that to me I will not post anywhere until the scheduled date)You (the client/commissioner):-You may upload the commissioned artwork on any website and social channels.
-You may NOT make profits from the commissioned piece without commercial license
-You may NOT alter the commissioned artwork without my (the artist's) consent.
-You retain the rights to the intellectual property (IP).
-You may NOT use the commissioned artwork for commercial purposes. The license to the commissioned artwork may be purchased at any point - contact me for info.
